The concept of marriage

As the foundation of a family, marriage has been attached to many definitions. Thus, according to popular criteria, marriages are the communions that are taken from Heaven. Goethe believed that marriage was the beginning and the summit of all culture, while Proudhon considered it the sacred face of justice and the mystery of universal harmony.

Dictionaries usually define marriage as the free and consensual union between a man and a woman, a union that is carried out in accordance with the law and whose purpose is to lead to the founding of a new family. Most journalists and lawyers also accept this definition as the most accurate. Some jurists also introduce their own approaches to the definition of this concept, these approaches have more or less to do with their religion. Ronasc, for example, considered that the legal act by which a man and a woman establish a link between them is a union that is imposed by law and that can be broken whenever they want. In legal terminology, the word “marriage” is used in the following situations.

First of all, it is used to define a legal document that is signed by the future spouses in accordance with the law. In addition, it is used to define the celebration of the marriage itself, which means that it refers to the official ceremony within which the document is signed. Then, a status is defined, a status that is included in the family code and that refers to a legal institution, being therefore a set of rules that determine and govern this concept.

Seen from a general point of view, the act of marriage is very similar to the pact, being also a bilateral legal act, but it also encompasses the conception that everyone has the right to marry when they want and with whom they want. married to. In addition, once they marry, the two spouses remain equal in rights and in everything else, nullifying the marriage all its privileges except those that have to do with their personal assets, which are not divided in the event of divorce. Marriage is a civil act, as it can only be performed by a local authority. Also, this is supposed to be an agreement that is signed for life, but it seems that there are more and more cases where it doesn’t happen because the number of divorces is continuously increasing. Husband and wife are supposed to stay together for better or worse, but more and more people seem to forget these words or simply don’t appreciate them, with divorce being just as significant an event as marriage itself.

Of course, everyone has the right to get married, just as everyone has the right to divorce if they feel there is nothing more they can do to save their marriage. However, marriage is supposed to set the stage for a new family, while divorce only separates a family that should never be separated.
